If found in violation, DraftKings could face a fine of $350,000. The company will have the opportunity to request a hearing, and no fine will be issued until it has received due process. In addition to the potential fine, the commission may also require DraftKings to put in place new procedures to ensure that marketing materials are not directed at individuals whose age has not been verified.

Earlier in December, the commission also fined Barstool Sports for promoting its sportsbook at a university campus event.
